Anti-union discrimination in court, dismissals of tade union members and violation of womens rights to equal pay legal opinion by expert Annett Olofsson

This legal opinion examines a case in a Latvian Court on the discrimination of a female worker according to wage and working hours. The female worker's working conditions were worse than those of her male colleagues. The state of Latvia allowing this discrimination violates ILO C 100 and ILO C 111. There is also a violation of the European Social Charter. Moreover the discrimination is in obvious conflict with Community law.

 

 

Protection of pregnant women from dismissal legal opinion by expert Wiebke Düvel

The question discussed in this article is what protection from dismissal, in accordance with ILO and EU legal standards, a pregnant woman can obtain before the prenatal leave, i.e. approx. in the first seven months of pregnancy. The opinion will focus on maternity leave and on the probation period regarding dismissal protection.
