Rome Statute of the International Criminal Court

Articles where children are specifically mentioned are 6.e and 7.2.c. Article 6.e defines genocide as an act committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such inter alia, forcibly transferring children of the group to another group. Article 7.2.c includes enslavement as being a crime against humanity. Enslavement means the exercise of any or all of the powers attaching to the right of ownership over a person and includes the exercise of such power in the course of trafficking in persons, in particular women and children.

International Covenant on Civil and Political Rights

Articles where children are specifically mentioned are 14, 23 and 24. Article 14 states that any judgement rendered in a criminal case or in a suit at law shall be made public except where the interest of juvenile persons otherwise requires, or the proceedings concern matrimonial disputes or the guardianship of children. Article 23 states that in the case of dissolution of marriage, provision shall be made for the necessary protection of any children. Article 24 addresses the rights of children concerning registration after birth, having a name, aquiring a nationality and being protected without any discrimination as to race, colour, sex, language, religion, national or social origin, property or birth.

Declaration on the Elimination of Violence against Women

Articles where children are specifically mentioned are 2 and 4.g. Article 2 states that violence against women shall be understood to encompass inter alia sexual abuse of female children in the household. According to article 4.g, states should work to ensure that women subject to violence and their children have specialized assistance, such as rehabilitation and assistance in childcare to promote their safety and physical and psychological rehabilitation.

UN RESOLUTIONS

 

Second Decade to Combat Racism and Racial Discrimination

Provision where children are mentioned is article 8.c, which states that the Secretary General, in implementing the plan of activities set forth in the Resolution, is to take into account inter alia the effects of racial discrimination on the children of minorities.

Guiding Principles on Internal Displacement

Principles where children are specially mentioned are 4, 11, 13, 17 and 23. Principle 4 states that certain internally displaced person, such as inter alia children, shall be entitled to protection and assistance required by their condition and to treatment which takes into account their special needs. Principle 11 states that internally displaced persons shall be protected in particular against inter alia forced labour of children. Article 13 prohibits the recruitment of displaced children to take part in hostilites. Article 17states that families which are separated by displacement should be reunited as quickly as possible, especially when children are involved. Article 23 addresses the need for free education for displaced children.
